Fitnos Limited Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Fitnos platform, including our mobile applications, websites, software, technology, products, content, and related services (collectively, the “Services”).

By creating an account, accessing, or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Services.

1. About Fitnos

Throughout these Terms, “Fitnos”, “we”, “our”, and “us” refer to Fitnos Limited.

2. Eligibility

You must be at least sixteen (16) years old to access or use the Services.

By creating an account, you confirm that:

• you are at least 16 years old;
• you have the legal capacity to enter into these Terms;
• all information provided by you is accurate and truthful;
• you will keep your information up to date.

Fitnos does not knowingly permit users under the age of 16 to access or use the Services.

If we believe a user is under the age of 16, we may suspend or permanently remove the account without notice.

3. The Fitnos Service

Fitnos is a social fitness platform that allows users to:

• share fitness-related photographs and content;
• participate in fitness communities;
• create and join groups;
• react to content;
• track fitness-related activity;
• discover communities and activities;
• engage with fitness-focused social experiences.

Fitnos may introduce, modify, suspend, or remove features at any time without liability.

We do not guarantee that any particular feature will remain available.

4. Account Responsibilities

You are responsible for your account and all activity occurring under it.

You agree:

• not to share your account credentials;
• not to allow another person to access your account;
• not to impersonate another individual;
• not to create accounts using false information;
• not to create multiple accounts for deceptive purposes;
• not to bypass account restrictions or bans.

You must maintain the security of your password and device.

You are responsible for any activity conducted through your account.

5. User Content

“Content” includes any material uploaded, posted, shared, submitted, or otherwise made available through the Services, including:

• photographs;
• profile information;
• captions;
• workout information;
• group content;
• reactions;
• usernames;
• fitness-related updates.

You retain ownership of the Content you create and upload.

However, by uploading Content to Fitnos, you grant Fitnos a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to:

• host;
• store;
• process;
• reproduce;
• display;
• distribute;
• modify;
• format;

such Content solely for the purposes of operating, maintaining, improving, securing, promoting, and providing the Services.

This licence terminates when Content is deleted, except where:

• retention is required by law;
• retention is necessary for security purposes;
• the Content has already been shared with other users;
• retention is reasonably required for dispute resolution or enforcement purposes.

6. Content Responsibility

You are solely responsible for Content you upload or share.

You represent and warrant that:

• you own the Content or have permission to use it;
• your Content does not infringe intellectual property rights;
• your Content does not violate applicable laws;
• your Content does not violate these Terms or our Community Guidelines.

Fitnos does not endorse, verify, or guarantee the accuracy of user-generated Content.

7. Screenshots and Content Sharing

Fitnos is designed around social sharing.

You acknowledge and accept that:

• other users may view Content you share;
• screenshots may be taken;
• photographs may be copied;
• Content may be redistributed by users outside the Services.

While we may provide privacy controls, Fitnos cannot prevent users from copying or redistributing Content once viewed.

You should never upload Content that you would not be comfortable being seen or shared by others.

8. Community Standards

Users must comply with our Community Guidelines at all times.

You must not:

• harass, threaten, intimidate, or abuse others;
• engage in bullying behaviour;
• promote violence;
• upload unlawful content;
• upload sexually explicit content;
• upload content involving minors in inappropriate circumstances;
• share content encouraging self-harm;
• share dangerous fitness challenges;
• promote illegal drugs;
• engage in hate speech;
• spam users or groups;
• create fake accounts;
• manipulate engagement;
• interfere with the operation of the Services.

Fitnos reserves the right to determine whether Content or behaviour violates these Terms.

9. Groups

Users may create and manage groups within the Services.

Group creators remain responsible for:

• maintaining appropriate behaviour within their groups;
• complying with these Terms;
• complying with Community Guidelines.

Fitnos reserves the right to:

• remove groups;
• restrict groups;
• remove group administrators;
• delete group content;
• suspend groups entirely.

10. Fitness Disclaimer

Fitnos is a technology platform and social network.

Fitnos does not provide:

• medical advice;
• healthcare services;
• physiotherapy;
• nutritional advice;
• personal training services;
• coaching services;
• professional fitness instruction.

Any fitness-related information, advice, content, training plans, exercises, workouts, or recommendations made available through the Services are provided for informational and social purposes only.

You should consult appropriately qualified professionals before undertaking any exercise programme.

11. Assumption of Risk

Exercise and sporting activities involve inherent risks.

These risks may include:

• injury;
• illness;
• permanent disability;
• property damage;
• death.

By using the Services, you acknowledge and accept these risks.

You voluntarily participate in any fitness activity, workout, challenge, event, training programme, or sporting activity discussed, shared, or organised through the Services entirely at your own risk.

12. User Interactions

Fitnos does not supervise, monitor, organise, endorse, or control offline interactions between users.

This includes:

• gym sessions;
• training sessions;
• fitness meetups;
• sports participation;
• competitions;
• events;
• community activities.

Users are solely responsible for assessing the safety, suitability, legality, and appropriateness of any interaction or activity.

Fitnos accepts no responsibility for conduct occurring outside the Services.

13. Moderation and Enforcement

To protect users and maintain platform integrity, Fitnos may:

• review Content;
• investigate reports;
• remove Content;
• restrict visibility;
• suspend accounts;
• terminate accounts;
• remove groups;
• limit functionality.

These actions may occur with or without notice where reasonably necessary.

Fitnos has no obligation to host, maintain, or display any Content.

Moderation decisions are made at Fitnos’ sole discretion.

14. Advertising and Sponsored Content

The Services may contain:

• advertisements;
• sponsored content;
• promotional campaigns;
• partner content.

Fitnos may receive compensation from advertisers and commercial partners.

The appearance of advertisements does not constitute endorsement by Fitnos.

Users remain responsible for evaluating any third-party products or services.

15. Premium Features and Payments

Fitnos may introduce paid features, subscriptions, or premium services.

Where applicable:

• pricing will be displayed before purchase;
• subscriptions may automatically renew;
• cancellation procedures will be provided through the relevant payment platform;
• payments may be processed by third-party providers.

Fitnos does not store full payment card information.

Additional subscription terms may apply to premium products.

16. Intellectual Property

The Services and all associated intellectual property rights are owned by Fitnos or its licensors.

This includes:

• software;
• branding;
• logos;
• graphics;
• designs;
• trademarks;
• databases;
• platform functionality.

Except as expressly permitted, you may not:

• copy;
• distribute;
• modify;
• reverse engineer;
• sell;
• licence;
• exploit

any portion of the Services.

17. Third-Party Services

The Services may integrate with third-party platforms and providers.

Fitnos is not responsible for:

• third-party websites;
• third-party applications;
• third-party services;
• third-party content.

Your use of third-party services is governed by their own terms and policies.

18. Service Availability

Fitnos is provided on an “as available” and “as is” basis.

We do not guarantee:

• uninterrupted operation;
• error-free functionality;
• continuous availability;
• compatibility with all devices;
• permanent availability of Content.

Fitnos may experience outages, maintenance periods, delays, bugs, or technical failures.

19. Limitation of Liability

Nothing in these Terms excludes liability where such exclusion would be unlawful under applicable law.

Subject to the foregoing, to the maximum extent permitted by law, Fitnos shall not be liable for:

• indirect losses;
• consequential losses;
• loss of profits;
• loss of revenue;
• loss of goodwill;
• loss of data;
• personal decisions made based on Content;
• injuries arising from fitness activities;
• conduct of other users;
• third-party actions.

To the maximum extent permitted by law, Fitnos’ total aggregate liability arising from or relating to the Services shall not exceed the greater of:

• (a) £100 GBP; or
• (b) the total amount paid by you to Fitnos during the twelve (12) months immediately preceding the event giving rise to the claim.

20. Indemnity

You agree to indemnify and hold harmless Fitnos, its directors, officers, employees, contractors, affiliates, and representatives from any claims, damages, liabilities, losses, costs, or expenses arising from:

• your use of the Services;
• your Content;
• your breach of these Terms;
• your violation of applicable laws;
• your infringement of third-party rights.

21. Termination

You may stop using the Services at any time.

Fitnos may suspend or terminate access where:

• these Terms are breached;
• Community Guidelines are breached;
• unlawful conduct is suspected;
• user safety is at risk;
• platform integrity is threatened.

Termination may occur without prior notice where reasonably necessary.

22. Changes to the Services

Fitnos may modify, suspend, discontinue, replace, or remove any aspect of the Services at any time.

We are not liable for any resulting loss or inconvenience.

23. Changes to These Terms

Fitnos may update these Terms from time to time.

Where changes are material, we may provide notice through:

• the Services;
• email;
• website notices;
• other reasonable means.

Continued use of the Services following an update constitutes acceptance of the revised Terms.

24. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Scotland.

Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the Scottish courts.
